1. Agreement to Terms

These Terms of Service govern your access to and use of sleepycosmetics.com (the “Site”) operated by Sleepy Cosmetics (“we”, “us”, “our”). By visiting the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to place an order. By purchasing you represent that you meet this requirement and that the information you provide is accurate and complete.

3. Products, Shades & Availability

We make every effort to display our products and their colors accurately. However, actual shades may differ from how they appear on your screen due to monitor settings, lighting, and photography. Slight variation between batches is normal in cosmetics and is not considered a defect.

All products are subject to availability. We reserve the right to limit quantities, discontinue any product, and refuse or cancel any order at our discretion, including where a product has been listed at an incorrect price.

4. Pricing & Payment

All prices are listed in United States Dollars (USD) and are subject to change without notice. Prices do not include shipping, duties, or applicable taxes, which are calculated at checkout or levied by your destination country. Payment must be received in full before an order is dispatched.

5. Orders & Cancellation

Your order constitutes an offer to purchase. Order confirmation does not guarantee acceptance; a contract is formed only when we dispatch your order. Cancellation is possible only before an order enters fulfillment, as described in our Returns & Refunds Policy.

6. Shipping & Risk of Loss

Delivery timeframes are set out in our Shipping Policy and are estimates only. Risk of loss passes to you upon delivery by the carrier to the address you provided.

7. Returns

All sales are final except in the limited circumstances described in our Returns & Refunds Policy, which forms part of these Terms.

8. Cosmetic Product Safety & Disclaimer

Please read this section carefully.

Our products are cosmetics intended for external use only. They are not medicines and are not intended to diagnose, treat, cure, or prevent any disease or condition.
Statements about our products have not been evaluated by the U.S. Food and Drug Administration.
Always perform a patch test on a small area of skin before first use, particularly for products used near the eyes or lips.
Discontinue use immediately if irritation, redness, swelling, or discomfort occurs, and seek medical advice.
Keep all products out of reach of children. Avoid direct contact with the eyes unless the product is specifically formulated for eye use. Do not use on broken, irritated, or sunburned skin.
It is your responsibility to review product ingredients and confirm suitability if you have allergies, sensitivities, or a known skin condition. Consult a dermatologist or healthcare professional if you are unsure.
False lashes and lash adhesives should be applied carefully and never directly to the eye. Remove gently and discontinue use if irritation occurs.

All content on the Site, including the Sleepy Cosmetics name and logo, product imagery, text, graphics, and layout, is our property or licensed to us and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

10. Acceptable Use

You agree not to use the Site for any unlawful purpose, to attempt unauthorized access to our systems, to transmit malicious code, to scrape or harvest data, or to interfere with the operation or security of the Site.

11. Third-Party Links

The Site may contain links to third-party websites and services. We do not control and are not responsible for their content, policies, or practices. Accessing them is at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law, Sleepy Cosmetics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded.

You agree to indemnify and hold harmless Sleepy Cosmetics and its operators from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site or our products.

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute shall be subject to the exclusive jurisdiction of the state and federal courts located in Orange County, California.
